You agree not to use viaPrize for any unlawful or prohibited activities, including but not limited to:

• Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
• Posting, uploading, or distributing any inappropriate, defamatory, obscene, or unlawful content.
• Interfering with or disrupting the platform or servers or networks connected to the platform.

5. Crowdfunding Campaigns

viaPrize allows users to create and contribute to crowdfunding campaigns for various prizes. By creating or contributing to a campaign, you agree to the following:

• Campaign creators must provide accurate and complete information about their campaign, including the prize details and deadline.
• Contributions to campaigns may be refundable under certain circumstances:
  • If judges vote for a refund, refunds will be issued minus payment processing and platform fees.
  • If there are no submissions, refunds will be issued minus only the payment processing fees.
• viaPrize charges a 5% platform fee on donations, except for campaigns supporting good causes where the fee is waived.
• Contestants may submit a dispute if they disagree with the judges' decision. viaPrize admins will review the dispute and make a final determination.

6. No Offer or Solicitation

The information and materials presented on this website do not constitute an offer to sell, a solicitation to buy, or a recommendation or endorsement of any security or investment. The company is not making any representation that any investment will or is likely to achieve profits or losses similar to those discussed on this website.

7. Disclaimer of Warranties

The company makes no representations or warranties of any kind, express or implied, with respect to the accuracy, reliability, or completeness of the information provided on this website. viaPrize charges a service fee on contributions made to campaigns. The fee structure is detailed on our platform and may be subject to change. By using our platform, you agree to the applicable fees and payment terms.

9. Intellectual Property

viaPrize is released under the AGPL-3.0 open source license. This means that you are free to use, modify, and distribute the code, provided that any modifications or derivative works you distribute are also licensed under the AGPL-3.0. You are allowed to charge a fee for your modifications or services based on viaPrize, but you must also share the source code of those modifications.

10. Termination

viaPrize reserves the right to terminate or suspend your account and access to the platform at our sole discretion, without notice and for any reason, including but not limited to violation of these Terms.

11. Disclaimers and Limitation of Liability

viaPrize is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be error-free, secure, or uninterrupted. To the fullest extent permitted by law, viaPrize shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the platform.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Dover, Delaware.

You agree to comply with all applicable laws, rules, and regulations in connection with your use of this website, including but not limited to securities laws and regulations in your jurisdiction.
